Chapter 215 of the City Code is hereby adopted as follows: <br />CHAPTER 215 — JOINT POWERS AGREEMENTS <br />Section <br />215.01 Intent <br />215.02 Joint Powers Agreements <br />§ 215.01 INTENT. <br />It is often in the City's interest to enter into agreements with one or more other governmental <br />units in order to undertake projects, provide services or otherwise exercise powers in a manner <br />that is more efficient and cost effective than if the City acted alone. Such agreements are usually <br />limited in scope and duration and do not create a separate joint powers entity. In those instances, <br />however, where the joint powers agreement both creates a joint powers board and requires <br />ongoing financial contributions from the City, there is a potential for the City's financial <br />obligations to be disproportionate to the amount of control the City may exercise on the board. <br />Particularly in the area of public safety, such a disparity between funding and control may not be <br />in the City's best interests. Section 215.02 is intended to prevent such disparities in certain joint <br />powers agreements. <br />§ 215.02 JOINT POWERS AGREEMENTS. <br />The City shall not approve a joint powers agreement that (1) provides public safety services <br />(police or fire); (2) creates a joint powers board; and (3) requires financial contributions from the <br />City, unless the City's voting power on the joint powers board relative to the other board <br />members is proportional to the City financial obligations relative to the other board members. <br />Section 2. This ordinance shall be in force and effect from and after its passage and publication <br />according to the Lino Lakes City Charter. <br />Adopted by the Lino Lakes City Council this 28th day of December, 2015. <br />
