11 Reading: June 13, 2 016 Publication: July 5 2016 <br /> 2'Reading: 7, 2016 Effective: August <br /> CITY OF LINO LAKES <br /> ORDINANCE NO. 04-16 <br /> ORDINANCE TO REZONE PROPERTY FROM R,R, RURAL AND R-BR, <br /> RURAL-BUSINESS RESERVE AND TO PUD-PLANNED UNIT <br /> DEVELOPMENT FOR WATERMARK <br /> The City Council of Lino Lakes ordains: <br /> Section 1: Findings of Fact <br /> 1. The City received a Land Use Application to rezone certain property from R, <br /> Rural and R-BR, Rural-Business Reserve to PUD-Planned Unit Development. <br /> 2. The Planning and Zoning Board held a public hearing on April 13, 2016 and <br /> continued the hearing to May 11,2016. <br /> 3. Per Section 1007.015 (5),the Planning and Zoning Board shall consider possible <br /> adverse effects of the proposed rezoning and its judgement shall be based upon, <br /> but not limited to,the following factors: <br /> (a) The proposed action has been considered in relation to the specific policies <br /> and provisions of and has been found to be consistent with the official City <br /> Comprehensive Plan. <br /> The proposed Watermark PUD master planned residential development is consistent with <br /> the goals and policies of the comprehensive plan in regards to resource management, <br /> land use, housing, transportation and utilities. The development upholds the City's public <br /> values by creating a multi-functional open space greenway corridor integrated with the <br /> stormwater conveyance system, wetland management and trails. Watermark is consistent <br /> with mixed-use land and density requirements and provides a variety of market driven <br /> housing products that support life-cycle housing. Safe transportation corridors and <br /> public utilities also serve the development. <br /> (b) The proposed use is or will be compatible with present and future land uses of <br /> the area. <br /> The proposed Watermark development is compatible with the present and future land <br /> uses of the area. Existing and future land use to the west is residential. Existing and <br /> future land use to the south is commercial. This area will be accessible via pedestrian <br /> corridors to support mixed use development. Existing land use to the north is rural <br /> residential and guided post-2030 for urban reserve. <br /> i <br />
