1St Reading: <br />8/22/2016 <br />Publication: <br />q/ 20/ 201 h <br />2nd Reading: <br />9/12/2016 <br />Effective: <br />1 n/ 2n / 7 n 1 h <br />CITY OF LINO LAKES <br />ORDINANCE NO. 09-16 <br />AN ORDINANCE AMENDING CITY CODE SECTION 1007 BY ADDING SECTION <br />1007.056 OPTING -OUT OF THE REQUIREMENTS OF <br />MINNESOTA STATUTES, SECTION 462.3593 <br />The City Council of Lino Lakes ordains: <br />Section 1. Purpose. On May 12, 2016, Governor Dayton signed into law the creation and <br />regulation of temporary family health care dwellings, codified at Minn. Stat. § 462.3593, which <br />permit and regulate temporary family health care dwellings and subdivision 9 of Minn. Stat. <br />§462.3593 allows cities to "opt out" of those regulations. <br />Section 2. Amendment. Lino Lakes City Code Chapter 1007 is hereby amended as set forth <br />below by adding Section 1007.056 as follows: <br />Section 1007.056 Opt Out of Minn. Stat.462.3593. Pursuant to authority granted by <br />Minnesota Statutes, Section 462.3593, subdivision 9, the City of Lino Lakes opts -out of <br />the requirements of Minn. Stat. §462.3593, which defines and regulates Temporary <br />Family Health Care Dwellings. <br />Section 3. Effective Date. This Ordinance shall be effective from and after its passage and <br />publication according to the Lino Lakes City Charter. <br />Adopted by the Lino Lakes City Council this 12th day of September, 2016. <br />The motion for the adoption of the foregoing ordinance was introduced by Council <br />Member Rafferty and was duly seconded by Council Member Manthey and upon <br />vote being taken thereon, the following voted in favor thereof: <br />Rafferty, Manthey, Kusterman, Reinert <br />The following voted against same: <br />Maher <br />ATTEST: <br />Jeff Reine Mayor <br />
