In our city the City Clerk is the Data <br />Practice and Data Authority that is designated and voted on at the first council meeting of each year by <br />the city council. This is not a requirement in our Charter or By -Laws. <br />would like to know does your City Charter Commission at their first meeting of each year or any <br />meeting, designate who is the Data Practice and or the Data Authority Person by resolution or stating in <br />the meeting who that person is for the Charter Commission? <br />Is the Data Practice 1 Authority Person's designated forthe council and city, also the Data Practice / <br />Authority for the City Charter Commission? <br />1 look forward to your reply and appreciate your timely response. I've attached a couple sections of State Statutes for quick reference with the first one <br />being the duties and responsibilities of Charter Commissions (MN Statutes 410.05) and Statute <br />13.05 regarding the appointment or designation of the Data Practices Compliance Official. <br />Neither Statute mandates that Charter Commissions appoint a Data Practices Compliance <br />Official, but rather the individual appointed by the City would handle any of the data practices <br />requests that would involve the Charter Commission. Charter Commissions are required to <br />meet once a year for their annual meeting in which they elect officers and approve their annual <br />report to the District Court Judge. The City of Plymouth's Charter Commission conducts their <br />annual meeting the first week in December. If there are no issues to discuss for the upcoming <br />year, their only meeting will be the ann!ial mPatinn in Ilcrcmhor <br />
