Investigative Report <br />November 12, 2008 <br />Page 2 <br />1. A gathering of three Lino Lakes council members to discuss official business <br />of the city constitutes a meeting. <br />2. A meeting (work session) of the Lino Lakes City Council occurred on July <br />28, 2008 at 5:30 p.m. Notice of the meeting was properly made. All members of the <br />City Council and the Mayor were present. <br />3. At the work session, the Mayor distributed a letter dated July 18, 2008 <br />addressed to the Mayor from Cori Duffy, Chair of the Lino Lakes Charter <br />Commission. <br />4. The activities of the Lino Lakes Charter Commission are a significant issue to <br />the Lino Lakes City Council. <br />5. A regular meeting of the Lino Lakes City Council occurred on July 28, 2008 <br />commencing at 6:30 p.m. Notice of the meeting was properly made. All members of <br />the City Council and Mayor attended the meeting, which took place in the council <br />chambers. <br />6. At 7:15 p.m. on July 28, 2008, the council, upon motion made and seconded, <br />voted to adjourn the meeting. <br />7. Following the vote to adjourn, neither the council collectively nor <br />individually sought to remove anyone from the council chambers or otherwise <br />prevent anyone in attendance from observing the conduct within the council <br />chambers. <br />8. Following the vote to adjourn, two to four distinct conversations occurred <br />involving City Council members and/or City staff. <br />9. Within two to five minutes following the vote to adjourn, two of the five <br />Council members had left the Council chambers. <br />10. Within five to ten minutes following the vote to adjourn, a third Council <br />member left the Council chambers, leaving one Council member and the Mayor in <br />the Council chambers. <br />DETERMINATION <br />The Lino Lakes City Council held a regular meeting on July 28, 2008. Following the motion <br />to adjourn, several council members engaged in conversations, either with other council <br />members or with city staff. The Complainant, a member of the council, alleged that he heard <br />the words "charter" and "amendment" being used by a staff person. As one of the first <br />
