<br />WS – Item 3 <br /> <br />WORK SESSION STAFF REPORT <br />Work Session Item 3 <br /> <br /> <br />Date: September 5, 2017 <br /> <br />To: City Council <br /> <br />From: John Swenson, Public Safety Director <br /> <br />Re: Police Body Worn Cameras (BWC) <br /> <br /> <br />Background <br /> <br />The Police Division is in the process of researching and testing camera systems that <br />would be worn by officers while responding to calls for service, during police initiated <br />interactions, and other relevant interactions with members of the public. This tool will <br />enable police personnel to record police public interactions to <br />• further enhance the documenting of these interactions; <br />• use the video footage for investigative purposes; <br />• assist with any decisions related to prosecution; <br />• assist with court procedures; and <br />• provide a resource in the handling of any civil litigation. <br /> <br />During the 2016 Minnesota Legislative session, statute 626.8473 was adopted and <br />requires that law enforcement agencies provide an opportunity for public comment <br />related to police BWC. This legislation also requires law enforcement agencies to have a <br />written policy governing the use of police BWC. Attached to this staff report is MN <br />Statute 628.8473. <br /> <br />Once staff has completed the evaluation of BWC systems, a draft policy governing the <br />use of police BWC will be posted on the Public Safety Department webpage seeking <br />public comment. Staff will also request that Council conduct a public hearing during a <br />regularly scheduled Council meeting as required by MN statute 626.8473. <br /> <br />Staff anticipates this public comment period will begin this fall with a public hearing <br />taking place in November or December of 2017. <br /> <br />The cost for the purchase of the BWC system will be covered by the Federal Narcotics <br />Forfeiture Fund, which is a permissible use of this fund. <br /> <br />This report is for Council information only; no Council action is needed at this time. <br /> <br />Attachments <br /> <br />Minnesota Statue 626.8473
