Task Force Proposal: None; same as Chapter 429. <br />Charter Commission Proposal: <br />Reverse referendum only, when an improvement is <br />funded in part through "general revenue." Section 8.09, <br />subd. 1. If registered voters equal to at least 12% of the <br />number of votes cast in the last mayoral election file a <br />petition before the first regular Council meeting <br />following the 60 -day period after the public hearing, the <br />Council shall order the question to be put on the ballot at <br />the next general or special election. If a majority of <br />those voting on the question are opposed, the Council <br />shall not proceed with the improvement. [In the <br />November 2006 election, 2,116 votes were cast for <br />mayor, so 254 registered voters would be needed to file <br />a successful petition today.] <br />Citizen Proposal: None; see taxpayer petition against the improvements <br />described above. <br />7. COST INCREASE PROVISIONS. <br />Chapter 429: <br />Existing Charter: <br />No express provision limiting cost increases over the <br />amounts estimated at the time of the hearing. However, <br />Section 429.031, subd. 1 (g) provides that the resolution <br />ordering the improvement may not increase the "extent <br />of the improvement" as stated in the notice of hearing. <br />If bids exceed the cost estimated by the engineer at the <br />time of the public hearing by more than 10%, the council <br />may not award the contract. The Council may re -bid the <br />improvement one time only. <br />Task Force Proposal: Same as Chapter 429. <br />Charter Commission Proposal: Same as Existing Charter. <br />Citizen Proposal: Same as Existing Charter. <br />8. SPECIAL RULES IN IDENTIED COMMERCIAL AREAS. <br />Chapter 429: Not applicable. <br />Existing Charter: <br />Chapter 429 governs in identified areas around Hodgson <br />Road and Lake Drive; Interstate 35-E and Main Street; <br />and Interstate 35-W and Lake Drive. However, owners <br />of single family, owner -occupied units that existed on <br />September 30, 1993 may opt out of any special <br />assessments. This right terminates when an owner - <br />occupied residential unit no longer exists on the parcel. <br />8 <br />
