3. IMPROVEMENTS INITIATED BY 100% PETITION. <br />Chapter 429: <br />Existing Charter: <br />Petition must be signed by owners of "all real property <br />abutting upon any street named as the location of any <br />improvement," requesting assessment of the "entire cost <br />against their property. Section 429.031, Subdivision 3. <br />No hearing needed, and council may approve by <br />majority vote. <br />Petition must be signed by 100% of the "benefited <br />owners." The improvement may not be approved until <br />after a public hearing (described below). After hearing, <br />another 60 -day waiting period is required before council <br />action unless all petitioners file a second petition to <br />waive 50 of the 60 days. <br />Task Force Proposal: Same as Chapter 429. <br />Charter Commission Proposal: <br />Substantially the same as Chapter 429. Petition must be <br />signed by 100% of the "property proposed to be <br />specially assessed," and must be accompanied by an <br />agreement to pay 100% of the cost of the improvements. <br />No hearing needed, and council may approve by <br />majority vote. <br />Citizen Proposal: Same as Charter Commission Proposal. <br />4. IMPROVEMENTS INITIATED BY LESS THAN 100% PETITION. <br />Chapter 429: <br />Existing Charter: <br />Petition must be signed by owners of at least 35% in <br />frontage of the real property abutting streets named in <br />the petition. Public hearing is required (described <br />below), and council may approve by majority vote. If <br />the petition is signed by less than 35%, or the council <br />itself initiates the improvement, the council must <br />approve by 4/5 vote (after the same hearing process as <br />for a 35% petitioned project). <br />Petition must be signed by 25% "in number of the <br />"benefited owners." Section 8.04, subd. 1. The council <br />may initiate the petitioned improvement by a majority <br />vote. Or, the council may initiate an improvement by a <br />4/5 vote. In either case, improvements may not be <br />finally approved until after the hearing and petition <br />process described below. <br />3 <br />
