STAFF ORIGINATOR: <br />MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />BACKGROUND <br />AGENDA ITEM 3B <br />Julie Bartell, City Clerk <br />September 8, 2008 <br />Resolution No. 08-98, Receiving Proposed Charter <br />Amendment and Calling a Special Election Thereon <br />(ballot language for citizen petition) <br />3/5 <br />On August 12, 2008, a petition was submitted to the City and the Lino Lakes Charter <br />Commission by the Lino Lakes Citizens for Safer Roads. The petition requests <br />amendment of the City Charter regarding procedures for special assessments for <br />public improvement projects. The form of the petition was found to meet the statutory <br />requirements related to charter amendments and petitions. Since only registered <br />voters are allowed to sign such a petition, all signatures were checked and registered <br />voters totaled. On August 20, 2008, the petition was found to be insufficient and the <br />petitioners were so informed. <br />On August 28, 2008, as allowed by state statute, a supplemental petition was <br />submitted by the petitioners. The petition, including the supplemental pages, was <br />found to be sufficient in signatures and therefore was certified. <br />The state statute governing charter amendments designates that the governing body <br />(the city council in this case) fix form of the ballot for all amendments. <br />The City's attorney has prepared the attached resolution calling for an election and <br />setting the ballot relative to the citizen proposed charter amendment for the council's <br />consideration. <br />RECOMMENDATION <br />City Council consideration of Resolution No. 08-98, Receiving Proposed Charter <br />Amendment and calling a Special Election thereon. <br />ATTACHMENTS <br />Text of the charter amendment, as attached to the citizen petition <br />Text that is included on the signature pages of the citizen petition <br />Certification of the petition <br />
