ACTION <br />CHAPTER 8 OF CITY CHARTER <br />MINNESOTA STATUTES CHAPTER 429 <br />Referendum <br />After petition or resolution: <br />If less than 100% of the cost of the improvement is <br />to be paid for by special assessments, connection <br />charges, "or any outside funding sources other than <br />the City general fund," the Council shall submit <br />the proposed improvement "and its assessment <br />formula" to the voters within 120 days after <br />conclusion of the public hearing. If a majority of <br />those voting on the question are opposed, the <br />Council shall not proceed with the improvement. <br />There is no referendum requirement to order an <br />improvement under Chapter 429. <br />Re -ordering after <br />disallowance. <br />After petition or resolution: <br />When an improvement is "disallowed" under the <br />Charter, the Council shall not vote on the same <br />improvement within one year after the public <br />hearing on that improvement. <br />There is no "disallowance" concept in Chapter 429. <br />Entering contracts <br />After petition or resolution: <br />Contracts shall be entered within one year after <br />adoption of the resolution ordering the <br />improvement, unless a different time limit is <br />specifically stated in the resolution. The Charter does <br />not contain this provision, but Chapter 429 imposes this <br />requirement even where the charter is silent. <br />If bids exceed the cost estimated by engineer at the <br />time of the public hearing by more than 10%, the <br />council may not award the contract. Council may <br />re -bid the improvement one time only. <br />After petition or resolution: <br />Contracts shall be entered within one year after adoption <br />of the resolution ordering the improvement, unless a <br />different time limit is specifically stated in the resolution. <br />A. After petition: <br />There is no express provision limiting the contract <br />amount, except that valid waivers of special assessment <br />appeal rights must state a maximum amount.
