Staff recommended approval of amending the <br />findings of Facts and Resolution No. 15-119. <br /> <br />On October 14, 2015, the Planning & Zoning Board recommended approval of a 10 foot <br />variance to allow the property owner, Dylan Lindman, to construct an attached garage 30 <br />feet from the lot line along CSAH 34/Birch Street. The required setback is 40 feet. <br /> <br />On October 26, 2015, the City Council passed Resolution No. 15-119 approving a 12 foot <br />variance to allow for the construction of an attached garage 28 feet from the lot line. The <br />property owner requested the additional 2 feet. <br /> <br />Per Resolution No. 15-119: <br /> <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino <br />Lakes hereby approves of a 12 foot variance to reduce the required setback from 40 feet <br />to 28 feet along Birch Street to allow for the construction of an attached double garage at <br />6602 Pheasant Run, subject to the following conditions: <br /> <br />1. The detached shed in the northeast corner of the lot, found in violation of city <br />ordinances, shall be relocated onto the applicant’s property. <br />2. The accessory structure shall meet the requirements of §1007.043 General <br />Building and Use Provisions. <br />3. The accessory structure shall meet all other city code and state building code <br />requirements. <br />4. A building permit shall be submitted for by the applicant and approved by the <br />City of Lino Lakes prior to construction. <br /> <br />The property owner thought the variance applied to both the attached double garage and <br />detached shed. He relocated the detached shed onto the property 28 feet from the south <br />lot line to line up with attached garage. Technically, the resolution only allowed for a <br />setback variance for the attached double garage, not the detached shed. The detached <br />shed should be 40 feet from the south lot line and 5 feet from the rear lot line. <br /> <br />The property owner does not want to relocate the detached shed again and is requesting <br />the variance to include the detached shed. <br /> <br />Staff addressed questions of the Board. <br /> <br />Mr. Stoesz asked if there needs to be approval to put up an accessory structure. Ms. <br />Larsen stated that if the structure is under 200 square feet, a zoning permit is required. If <br />the structure is over 200 square feet, a building permit is required. <br /> <br />Mr. Lindman stated that the shed is 26.8 feet from property line. <br />
