Both amendments seek to bring dates and timing into compliance with state law, and <br />make a minimum of changes to the Charter. Based on past discussions with you and other <br />Charter Commission members, 1 have made a few changes to the proposed language. The <br />revised language is attached in two versions. The first version shows the changes to the present <br />Charter, and explains the changes. The second version shows how the paragraphs would read if <br />the amendments passed. I also have attached a set of the changes without explanatory text. <br />Under Minn. Stat. § 410.12, subd. 7, the Charter Commission may recommend a Charter <br />amendment to the city council, which may then enact it by ordinance. The city council must <br />publish a notice of a public hearing on the proposed amendment within a month of receiving the <br />Charter Commission's recommendation, must hold the public hearing between two weeks and a <br />month after publication of the notice, and must vote on the proposed amendment within one <br />month of the public hearing. If approved by all city council members, it would become effective <br />90 days after passage and publication (or later, if a later date is chosen), and if not stopped by a <br />petition seeking a referendum on the amendment. <br />Please let me know if you have further questions or concems. <br />Sincerely, <br />MARTY I.AW FIRM, LLC <br />Karen E.
