AGENDA ITEM 513 <br />TO: Lino Lakes Charter Commission <br />FROM: Gordon Heitke, City Administrator <br />MEETING DATE: October 12, 2006 <br />TOPIC: Charter Amendment <br />BACKGROUND <br />The City Council was presented with a petition with more than 500 signatures at its <br />September 26, 2005 meeting. The petition requested that the City Council place the <br />question of whether "to not allow City Council Members (including the Mayor) to also <br />be members of the Lino Lakes Charter Commission" on the November 2006 election <br />ballot. The City attorney reviewed the petition and advised the City Council that the <br />petition was advisory in nature and that it is the decision of the Council whether to <br />carry out the request of the petitioners. <br />Based on the requirements of Minnesota Statutes, Section 410.12, Subdivision 5, the <br />proposed charter amendment was put into ordinance form, given a first and second <br />reading and submitted to the Charter Commission for their approval, rejection or <br />substitution. <br />The Charter Commission discussed the proposed amendment at their April 13, 2006 <br />and July 13, 2006 meetings, ultimately proposing a revision to the proposed <br />amendment and forwarding the matter back to the City Council. The City Council <br />discussed the issue at their September 6, 2006 work session and directed staff to <br />prepare the amendment as requested in the petition with no revisions for placement on <br />the ballot. The attached resolution referring the matter to the voters and approving the <br />ballot language was adopted by the Council on September 11, 2006. In turn, the <br />language was submitted to Anoka County before the deadline of September 15 to be <br />placed on the November 7, 2006 general election ballot. <br />ATTACHMENTS <br />1.
