CITY COUNCIL <br />AGENDA ITEM 6D <br /> <br />STAFF ORIGINATOR: Michael Grochala, Community Development Director <br /> <br />MEETING DATE: April 10, 2017 <br /> <br />TOPIC: Consider Second Reading of Ordinance 02-17, Approving Sale of <br />Land to American Legion Post 566. <br /> <br />VOTE REQUIRED: 3/5 <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consideration of the sale of land to American Legion Post 566. <br /> <br />BACKGROUND <br /> <br />In 1990 the Lino Lakes Economic Development Authority (EDA) purchased lots 12-16, Block <br />2, Carole’s Estates for the construction of a Public Safety complex including a new Fire <br />Station. The City acquired the land, from the EDA, through an installment purchase contract in <br />1990, as part of the project financing. In 1999, following completion of the Civic Complex, the <br />City sold the former Police Station (Lot 15) to the American Legion. The Legion has recently <br />expressed a need to expand parking to efficiently operate their existing facility. <br />Lot 14, Block 2 of Carole’s Estates 2nd Addition is immediately south of the American Legion <br />and is currently undeveloped. The property is approximately 1 acre in area. The property is <br />currently being used for community gardens as a temporary use pending its sale and <br />development. <br /> <br />Through negotiations with the American Legion the City Council has reached sale price of <br />$90,000. As part of the consideration the City will retain a 40 foot wide access, utility and <br />drainage easement across the easternmost portion of the lot. This will allow future <br />development access to Lots 12 and 13 which are still under City ownership. Staff will be <br />working with the City Attorney and American Legion representatives to finalize the purchase <br />agreement. <br /> <br />The City Council approved the 1st Reading on March 27, 2017. The City’s Economic <br />Development Authority will be executing a warranty deed, to the City, in accordance with the <br />1990 installment purchase contract. <br /> <br />RECOMMENDATION <br /> <br />Staff is recommending approval of the 2nd Reading of Ordinance No. 02-17. <br /> <br />ATTACHMENTS <br /> <br />1.
