Consider Resolution No. 17-53 Approving Maintenance <br />Agreement Stormwater Management Facilities <br /> <br />VOTE REQUIRED: 3/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consideration of a Site Improvement Performance Agreement <br />and Maintenance Agreement Stormwater Management Facilities for the Lino Lakes Elementary <br />School Renovation. <br /> <br />BACKGROUND <br /> <br />On November 14, 2016, Council approved Resolution No. 16-136 for a conditional use permit <br />and site plan review for a renovation at Lino Lakes Elementary School located at 725 Main <br />Street. The proposed renovation will create 4 additional classrooms, a large gathering space at <br />the front/south side of the building and an outdoor classroom to the west side of the building. <br /> <br />One condition of approval as noted in the City Engineer’s letter dated October 4, 2016 was the <br />need for more information regarding the pedestrian crosswalk across Main Street. Currently, <br />there is a sidewalk extending from the school parking lot south to a striped and signed <br />crosswalk across Main Street. Per the revised Site Plan dated May 15, 2017, the sidewalk and <br />crosswalk are being removed. Staff has concerns regarding these removals and pedestrian <br />safety but ultimately, it is the decision of the school and Anoka County. Attached are letters <br />from both agencies. <br /> <br />The Site Improvement Performance Agreement satisfies Section 1007.20(5)(d) that requires the <br />applicant submit to the City an agreement that they will cause all improvements called for in <br />the site and building plan review to be completed within the time specified by the City. <br /> <br />The Maintenance Agreement Stormwater Management Facilities satisfies Section <br />1011.011(8)(l) that requires a long term maintenance plans and schedule for all permanent <br />stormwater practices. <br />
