(3) Sept. 18, 1974 <br />Mr. Prokop and Mr. Jankus presented their revised petition to the Planning and <br />Zoning Board. They had also received a soil analysis from the Anoka County Soils <br />Department stating that the soils in that area are of the Hayden type and serve as <br />an excellent base for roads. Also, this type of soil provides for excellent <br />drainage. <br />Mx. Shearer felt that if the building permits could be restricted he would approve <br />alternative #3. <br />Lombardi wondered if the City can legally stop people from building on their <br />c,-swn property. He felt that this question will be resolved by the State and in not <br />:o'i distant future. <br />g'',rLocher reviewed the Johnson case where the building permit was denied but this <br />'as on a 20 foot easement. <br />There was discussion on the type of street that serves that area and Rolling Hills <br />.rive is an oiled street at the present and he felt that an oiled street in the <br />Lrea would be sufficient. <br />P{r. Locher brought up the requirement of extending the roadway 150 foot into Mr. <br />Ja--:kus's property and accepting this as a public roadway. <br />^_;-sire was more discussion on the possibility of other lots in the area being sold <br />aid the people applying for building permits. <br />Kelling moved to recommend to the Council a variance to Ordinance 22 under <br />:'sction 27 accepting alternate #3 with the stipulation that when other lots are <br />tp.td the street be brought up to City specifications, at property owners expense, <br />that the street be wind rowed with the oil, mixed and then packed down, this street <br />will be accepted for partial maintenance only, this to include the 150' into the <br />Jeakus property, building permits to be issued one to each of the two petitioners, <br />only, turn around into the Jankus property to end in a cul-de-sac with a 100' <br />eiameter. Seconded by Mr. Shearen. Motion carried. <br />Mr. Prokop thanked the Board and asked that copies of thise minutes be mailed to him. <br />Mere re was no old business. <br />ui3.nr new business, Mr. Hill brought up the problem of the horses at Old Highway 8 <br />-14 Elm Street. He felt that this situation should be looked into. The names of the <br />p:<•pie involved must be obtained first. <br />?x, Locher brought up the differences between the State statutes and the City <br />Oruinances in who is to be notified and how in the cases of rezoning. The City <br />Ordinances reads 'registered' mail but Mr. Locher has been using 'certified' mail <br />vith a return receipt requested. He felt this is sufficient and suggested that <br />pa -haps the Ord. should be changed to read as such. <br />Mr. Lombardi suggested the elimination of reading the entire legal description. He <br />thought if it was posted in the Hall this would be enough. The Board members agreed. <br />M=. Kelling moved to adjourn at 10:00 p.m. Seconded by Mr. Hill. Aye. <br />
