Since the property does not quality for an additional structure, the
109 applicant is asking consideration of the fact that the property includes a parcel of 17 acres of land
110 that is leased. Staff and the Planning and Zoning Board are recommending denial of the variance
l l request based on the findings included in the staff report.
112 The council noted that there was considerable discussion at the work session preceding this meeting
113 about this matter. While there is great interest in supporting an area busienss, there is concern about
114 setting a bad precedent if the variance were allowed.
115 Sandy Nordstrom, 1288 Main Street, addressed the council. She explained that she is in the
116 business of training horses and she would like the ability to cover the area she currently uses as a
117 training track so that it can be used year around. The business has become her sole occupation so
118 she needs to be able to operate as much as possible. The structure is portable and she'd be willing
119 to take it down if necessary.
120 The council explained to Ms. Nordstrom that they agonized over the question of denying this
121 variance. While they'd very much like to find a way to allow the structure, it would be very unwise
122 to set a precedent on the question of considering leased land.
123 Council Member O'Donnell moved that the item be postponed to the meeting of April 12, 2010,
124 and that staff be directed to look for a different approach that would allow the requested structure
125 (without a variance). Council Member Roeser seconded the motion. Motion carried on a voice
126 vote; Council Member Rafferty absent.
127 6B) First Reading of Ordinance No. 05-10 amending a Planned Unit Development by
128 amending the Town Center Design & Development Guide Regarding Outdoor Dining/Seating
129 —City Planner Smyser explained that staff is presenting a change to the specific design guidelines
130 for the Town Center area that would mirror recent changes to the zoning regulations relative to
131 outdoor dining/seating requirements.
3
