He is concerned about the proposed storm water utility and <br /> 140 fears that it is an end-run around the city charter. The city charter was enacted to help with growth <br /> 141 issues in the city and he warns that the voters will not be happy if the council tries to go around it. He <br /> 142 would like to see a cap on fees overall in the city and to have that included in the city charter. He <br /> 143 doesn't sympathize with folks that built homes on low lying lands. <br /> 144 <br /> 145 Mike Trehus, Lino Lakes resident. He asked if the council will be doing first reading tonight and was <br /> 146 told the council plans to conduct and continue the public hearing only tonight. He fears the proposed <br /> 147 ordinance to be like a blank check as he sees nothing in it that limits spending. At the public <br /> 148 informational meeting, the opinion was unanimous that this is setting up a revenue source outside the <br /> 149 general fund and concerns were expressed all around about how it would be controlled. While he <br /> 150 hears that the funds would be used only for maintenance, the feasibility report itself continually <br /> 151 contains the word "construct" so that doesn't concur. It could also overlap into what is governed <br /> 152 under the city charter and that question deserves consideration. Also he sees a jump in the <br /> 153 engineering budget that is not clearly explained and that says to him that revenue from this utility <br /> 154 could be involved. He asked the council to realize that the utility would stay after this council's good <br /> 155 intent leaves. <br /> 156 <br /> 157 Council Member Rafferty moved to continue the public hearing to the next regular meeting. Council <br /> 158 Member Roeser seconded the motion. Motion carried on a unanimous voice vote. <br /> •--159 <br /> 160 Council Member O'Donnell moved to postpone 1st Reading of Ordinance No. 09-10 to September <br /> 161 (the ordinance will be discussed at the work session).
