SPECIAL COUNCIL MEETING November 2, 2009 <br /> APPROVED <br /> 1 CITY OF LINO LAKES <br /> 2 MINUTES <br /> 3 SPECIAL COUNCIL MEETING <br /> 4 <br /> 5 DATE : November 2, 2009 <br /> 6 TIME STARTED : 5:33 p.m. <br /> 7 TIME ENDED : 6:42 p.m. <br /> 8 MEMBERS PRESENT : Council Members Reinert, Gallup, O'Donnell <br /> 9 and Mayor Bergeson <br /> 10 MEMBERS ABSENT : none <br /> 11 <br /> 12 Staff Present: Acting Administrator Dan Tesch; Community Development Director Michael <br /> 13 Grochala; Public Safety Director Dave Pecchia; City Attorney Joseph Langel; Deputy City Clerk <br /> 14 Jean Viger; Economic Development Coordinator Mary Alice Divine; City Clerk Julie Bartell <br /> 15 <br /> 16 Mayor Bergeson called the meeting to order at 5:33 p.m. in the Community Room at Lino Lakes <br /> 17 City Hall. <br /> 18 <br /> 19 Deputy Clerk Viger reviewed what had occurred to this point relative to the resignation of former <br /> 20 council member Stoltz including the council declaring by resolution a vacancy and Anoka <br /> 21 County instructing the city to proceed with the provisions of our city charter relative to <br /> 22 vacancies. The city has published and advertised as much as possible in the short period of time <br /> 23 allowed, a Notice of Vacancy, and that same notice will be posted on the city website and at all <br /> 24 polling places. If voters have questions about the vacancy and the process to fill it, they will be <br /> 25 referred to the notice or city hall. To avoid confusion election judges will not answer questions <br /> 26 but, if necessary,will instruct voters to vote for two as per the printed ballot. If a voter were to <br /> 27 vote for more than two, the voting machine will not accept the ballot and the voter will be given <br /> 28 an opportunity to revote or to override the machine whereby the votes for that race only would <br /> 29 not be counted. <br /> 30 <br /> 31 City Attorney Langel opined that the winner of the third seat (the third highest vote getter for city <br /> 32 council)would be filling a vacancy and therefore could take office as soon as possible.
