district. The minimum lot size in that district for newly <br />created parcels is 2 1/2 acres. Neither of the two parcels <br />meets that requirement either before or after the proposed <br />minor subdivision. A variance is required for creation of <br />undersized parcels. <br />No park dedication is required as no new buildable parcels <br />are being created. In theory anyway the owners could have <br />sold off the eastern part of their property for a dwelling as <br />it meets the requirements of having a separate legal <br />description, i.e. it's a lot of record. <br />Professional Opinion: It might be argued that by reducing <br />the vacant parcel from 255 feet to 230 feet, the city would <br />create a situation where the vacant land could be subdivided <br />into only two 80 foot wide parcels instead of three. This <br />would not be good use of the land for either the city or the <br />landowner. The other side of the coin is that some might <br />must be given to the present situation and that changing the <br />dimensions of the parcels works to "legalize reality." In <br />addition it could be argued that "the two -of -three rule" <br />could be applied to create three future lots measuring 76.6 x <br />202 feet. <br />My recommendation is to recognize the real world and <br />accommodate it. <br />Recommended Action: Motion to recommend to the city council <br />approval of a minor subdivision for Brad and Helen Elledge <br />for property located at 7790 Lake Drive, Application #89-48. <br />Motion to recommend to the city council approval of a <br />variance, Application #89-49 for Brad and Helen Elledge to <br />create an undersized lot in a suburban residential zoning <br />district; incorporating a existing drainfield, existing <br />kennel, and existing accessory building with the property on <br />which the dwelling (principal structure) is located. <br />
