<br /> ORDINANCE TO REZONE PROPERTY FROM R-X,RURAL EXECUTIVE
<br /> TO GB,GENERAL BUSINESS FOR ALL SEASONS RENTAL/SS
<br /> PROPERTIES ADDITION(7932 LAKE DRIVE)
<br /> The City Council of Lino Lakes ordains:
<br /> Section 1:Findings of Fact
<br /> 1. The City received a Land Use Application to rezone certain property
<br /> ^� from R-X,Rural Executive to GB,General Business.
<br /> 2. The Planning and Zoning Board held a public hearing on July 12,2017.
<br /> 3. Per Section 1007.015(5),the Planning and Zoning Board shall consid-
<br /> er possible adverse effects of the proposed rezoning and its judgement shall
<br /> be based upon,but not limited to,the following factors:
<br /> (a) The proposed action has been considered in relation to the spe-
<br /> cific policies and provisions of and has been found to be consistent with the
<br /> official City Comprehensive Plan.
<br /> All Seasons Rental is consistent with the official City Comprehensive
<br /> Plan. The parcels are guided commercial and the retail rental business is
<br /> consistent with that land use. The development is also consistent with the
<br /> goals and policies of the comprehensive plan in regards to resource manage-
<br /> ment,transportation,utilities and local water management plan-
<br /> (b) The proposed use is or will be compatible with present and future
<br /> land uses of the area.
<br /> All Seasons Rental is compatible with present and future land uses of
<br /> the area. Land uses surrounding the subject site are guided for commercial
<br /> development,mixed use and residential.
<br /> (c) The proposed use conforms with all performance standards con-
<br /> tained herein.
<br /> All Seasons Rental conforms with all performance standards with
<br /> some minor revisions as detailed in the July 12,2017 Planning&Zoning staff
<br /> report.
<br /> (d) The proposed use can be accommodated with existing public
<br /> services and will not overburden the City's service capacity.
<br /> All Seasons Rental can be accommodated with existing public ser-
<br /> vices. The new facility will be served by an 8"PVC sanitary sewer and a 12"
<br /> DIP watermain located along Kelly Street.The proposed commercial building
<br /> will not overburden the City's service capacity for either water or sanitary sew-
<br /> er.
<br /> (e) Traffic generation by the proposed use is within capabilities of
<br /> streets serving the property.
<br /> Traffic generated by All Seasons Rental is within capabilities of the
<br /> streets serving the property. CSAH 23/Lake Drive is a minor arterial reliever
<br /> street. Kelly Street is a local street.
<br /> Section 2:Amendment
<br /> The Zoning Ordinance of the City of Lino Lakes is hereby amended to
<br /> zone the following described property to GB,General Business.
<br /> Section 3:Legal Description
<br /> The parcel is depicted on Exhibit A attached herein and legally described
<br /> as follows:
<br /> PARCEL A:
<br /> That part of the North 135.00 feet of the west 248.50 feet of the South
<br /> Half of the Northwest Quarter of the Northwest Quarter of Section 9,Township
<br /> 31,Range
<br /> 22,Anoka County,Minnesota,lying easterly of State Trunk Highway No.
<br /> 8,except
<br /> that part taken for road,according to the United States Government Sur-
<br /> vey thereof,Anoka County,Minnesota.
<br /> AND
<br /> PARCEL B:
<br /> The North 135.00 feet of the east 80 feet of the west 328.50 feet of
<br /> the South Half of the Northwest Quarter of the Northwest Quarter,Section 9,
<br /> Township 31,Range 22,Anoka County,Minnesota.
<br /> AND
<br /> Lot 1,Block 1,PINE GLEN,Anoka County,Minnesota.
<br /> AND
<br /> All that part of Lot 5 AUDITOR'S SUBDIVISION NO. 100, Anoka
<br /> County,Minnesota,described as follows:
<br /> Beginning at the most Northerly corner of said Lot 5;thence Southerly on
<br /> the East line of said Lot 5,88.62 feet;thence Westerly at right angles,46.34
<br /> feet,more or less,to the Northwesterly line of said Lot 5(being the Southeast-
<br /> erly right of way line of old Highway 8,now County State Aid Highway No.23);
<br /> thence Northeasterly along said Northwesterly line to the point of beginning,
<br /> except Parcel 39,Anoka County Highway Right-of-Way Plat No. 17,Anoka

<br /> Section 4:Development Regulations n 1 $���
<br /> The development shall conform to the plans, requirements,and oondi- t`�
<br /> tions of approval as listed in Council Re_cotu" No 17-80 and No 17-81
<br /> Section 5:Effect
<br /> This ordinance shall be in force and effect from and after its passage and
<br /> publication according to the Lino Lakes City Charter.
