CITY OF LINO LAKES <br />RESOLUTION NO. 17-96 <br />RESOLUTION APPROVING AN EXTENSION OF TIME FOR THE SUBMITTAL OF <br />THE PUD FINAL PLAN/FINAL PLAT FOR WATERMARK <br />WHEREAS, review and approvals of plats are governed by Minnesota Statutes and City of Lino <br />Lakes ordinances; and <br />WHEREAS, on June 13, 2016 the City passed Council Resolution No. 16-51 approving a PUD <br />Development Stage Plan/Preliminary Plat for a residential development called Watermark; and <br />WHEREAS, Section 1007.024(6)(h)7 states unless a Final Plan covering the area designated in <br />the Development Stage Plan as the first stage of the PUD has been filed within one (1) year from <br />the date the City Council grants Development Stage Plan approval, or in any case where the <br />applicant fails to file Final Plans and to proceed with development in accordance with the <br />provisions of this Ordinance and/or an approved Development Stage Plan, the approval shall <br />expire. The City Council may at its discretion extend for six month intervals the filing deadline <br />for any Final Plan when, for good cause shown, such extension is necessary; and <br />WHEREAS, an extension of time for the submittal of the PUD Final Plan/ Final Plat by <br />December 13, 2017 was approved by the City Council on with Resolution No. 17-32; and <br />WHEREAS, Mattamy Homes has requested another 6 month extension while they finalize land <br />sale negotiations with Lennar. <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes, <br />1. The PUD Final Plan/Final Plat for Watermark shall be submitted by June 30, 2018 <br />unless an additional extension is granted by the City Council. <br />Adopted by the Council of the City of Lino Lakes this 9th day of October, 2017. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />Rafferty and was duly seconded by Council Member Manthey and upon <br />vote beingtaken thereon, the following voted in favor thereof: <br />Raferty, Manthey, Kusterman, Reinert <br />The following voted against same: <br />none (absent - Maher) <br />ATTEST: <br />e Bartell, C y Clerk <br />1 <br />Jeff Reinert, M. yor <br />
