1 CITY OF LINO LAKES RESOLUTION NO. 16-20 RESOLUTION APPROVING A CONDITIONAL USE PERMIT AMENDMENT AND SITE PLAN REVIEW FOR RICE LAKE ELEMENTARY SCHOOL ADDITION (575 BIRCH STREET) WHEREAS, the City has received an application for a conditional use permit amendment and site plan review for an addition to the existing elementary school for early childhood education hereafter referred to as “Development”; and WHEREAS, the property is zoned PSP, Public and Semi-Public and allows for schools (public and private) with a conditional use permit; and WHEREAS, per Section 1007.016(2)(n), the school is considered to have an existing conditional use permit because it was existing as of July 14, 1997 and any change involving a structural enlargement of the facility requires an amendment to the conditional use permit; and WHEREAS, the legal descriptions of the subject properties are: (Per Warranty Deed Doc. No. 937240) That part of Government Lot 4 Section 29, Township 31, Range 22, Anoka County Minnesota described as follows: Commencing at the southwest corner of said government Lot 4; thence North 00 degrees 39 minutes 48 seconds East, assumed bearing, 60.00 feet to the north right-of-way line of C.S.A.H. No. 10 and the point of beginning of the part to be described; thence South 88 degrees 52 minutes 59 seconds East 625.56 feet; thence north 00 degrees 43 minutes 03 seconds East 1262.73 feet to the north line of said government Lot 4; thence North 88 degrees 51 minutes 16 seconds west 626.80 feet to the West line of said government lot 4; thence South 00 degrees 39 minutes 41 seconds West along the west line of said government lot 4 a distance of 1263.06 feet to the point of beginning.
