On the Need for an Environmental Assessment Worksheet Findings of Fact <br />Bituminous Roadways, Inc. Hot Mix Asphalt Plant Project Conclusions of Law <br />Columbus, Minnesota And Order <br /> <br /> <br /> 10 <br />Air Quality – Dust <br /> <br />53. Minn. R. pt. 7011.0150 requires Bituminous to prevent fugitive dust emissions from becoming <br />airborne at the Project site. The Project design includes primary and secondary filtering systems at <br />the hot mix asphalt production process to capture fine sands and dust emissions. The coarsest <br />particles are captured in the primary collector and returned to the production mix. The finer <br />particles are collected in the secondary collector and returned to the production mix. <br /> <br />54. Bituminous will regularly spray any portable crusher and screens used to crush asphalt and cement <br />rubble to reduce dust. <br /> <br />55. The Bituminous CUP application (Appendix A of the Petition, Attachment 1 to Findings) states it will <br />pave the two access driveways at the Project site as well as the asphalt plant production area, <br />which will reduce dust. Bituminous will have a street sweeper onsite at all times to remove any <br />materials tracked onto County State Aid Highway (CSAH 54). In addition, the areas at the Project <br />site not paved will be surfaced with gravel and watered on an as-needed basis to prevent fugitive <br />dust from leaving the Project site. <br /> <br />56. The Bituminous CUP application states Project traffic will consist of trucks bringing raw materials <br />and hauling finished products, with the amount of trucks per day varying based on local <br />construction activity and product demand. Bituminous estimates traffic of peak day production to <br />generate approximately 250 round-trip truck visits, with approximately 120 trips leaving the Project <br />property with loads of asphalt, and the remainder consisting of trucks bringing aggregate and rubble <br />to the Project property or leaving the Project property with road base materials. <br /> <br />57. The Bituminous CUP application states that trucks importing and exporting materials from the <br />Project property will enter from CSAH 54 using the northernmost access drive as the primary <br />entrance to the Project property, and exit the Project property at the south access drive back out to <br />CSAH 54. Truck traffic from the site may head either north or south on CSAH 54. <br /> <br />58. MnDOT requires trucks be secured and transported to prevent loss of material onto the roadway <br />and surrounding areas. According to the MnDOT commercial vehicle manual, the manner of loading <br />is regulated under Minn. Stat. § 169.81, subd. 5, and, Minnesota has adopted the load securement <br />requirements of the Federal Motor Carrier Safety Regulations: <br />http://www.dot.state.mn.us/cvo/mcr/MnTruckRegl/MNTruckReg.pdf. <br /> <br />59. Bituminous will require truck drivers to clean any spills following loading or unloading, which will <br />help prevent excess dust. <br /> <br />60. The MPCA finds the proposed Project is designed to meet federal, state, and local requirements for <br />air emissions for hot mix asphalt production and materials storage at the Project property. <br /> <br />61. The MPCA finds that the Project, as it is proposed, does not have the potential for significant <br />environmental effects based on the type, extent, and reversibility of impacts related to air quality <br />that are reasonably expected to occur from the Project. <br />
