CITY COUNCIL <br />AGENDA ITEM 6A <br /> <br />STAFF ORIGINATOR: Katie Larsen, City Planner <br /> Joe Widing, Community Development Intern <br />MEETING DATE: September 11, 2017 <br />TOPIC: Public Hearing: Consider 1st Reading of Ordinance No. 08-17, <br />Vacating Drainage Easement on 520 62nd Street <br />VOTE REQUIRED: 4/5 <br />INTRODUCTION <br />Staff is requesting City Council consideration of Ordinance No. 08-17, vacating a drainage <br />easement over wetlands as dedicated on 520 62nd Street. <br />BACKGROUND <br />520 62nd Street is a rural residential parcel located east of Ware Road on the south side of 62nd <br />Street. The property owner, Eric Van Abel, has submitted a land use application requesting <br />vacation of a drainage easement over wetlands on the property. <br />The existing drainage easement over wetlands was originally dedicated to the City of Lino Lakes <br />in 2015 with the approval of the Walls Property minor subdivision into Parcel A and Parcel B, <br />with Parcel A being assigned the address 520 62nd Street. Parcel A was approved with a future <br />single family home being constructed on the north end of the parcel near 62nd Street. The current <br />owner, Eric Van Abel, would like to construct his home further south on the property into an <br />area currently covered by a drainage easement. Therefore, the applicant is requesting the <br />drainage easement that was originally approved with the minor subdivision be vacated to allow <br />for the construction of a new single family home. A new drainage easement over wetlands will <br />be re-dedicated over the parcel. <br />Rice Creek Watershed District has issued Permit No. 17-045 approving minor wetland <br />alterations for the driveway. A new wetland buffer and conservation easement has been <br />provided to RCWD. <br />RECOMMENDATION <br />Staff recommends adoption of Ordinance No. 08-17. <br />ATTACHMENTS <br />1.
