1 <br /> <br />CITY COUNCIL <br />AGENDA ITEM 6C <br /> <br /> <br />STAFF ORIGINATOR: Diane Hankee, City Engineer <br /> <br />MEETING DATE: November 13, 2017 <br /> <br />TOPIC: PUBLIC HEARING: Consider 1st Reading of Ordinance No. <br />12-17, Vacating Drainage & Utility Easements, Lot 2, Block 1, <br />St. Clair Estates <br /> <br />VOTE REQUIRED: 4/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consideration of Ordinance No. 12-17, Vacating Drainage & <br />Utility Easements, Lot 2, Block 1, St. Clair Estates. <br /> <br />BACKGROUND <br /> <br />The St. Clair Estates residential subdivision was platted in August of 2017. A builder for this <br />development, Sharper Homes, has requested a vacation of a drainage and utility easement on <br />Lot 2, Block 1. This lot is unique to the development due to the rear yard drainage system, as <br />shown on the enclosed map. <br /> <br />Sharper Homes is a semi-custom home builder, where they take standardized floor plans and <br />make modifications to accommodate a buyer's needs. Lot 2 Block 1 renders some of their floor <br />plans unavailable and may eliminate the possibility of a deck. Sharper Homes, is currently <br />working with a buyer for this lot, and would like to assure the buyer that the stock plan meets <br />their needs, and would allow for a modest deck. <br /> <br />ANALYSIS <br /> <br />The drainage and utility easement was put in place with the St. Clair Estates plat to maintain <br />public access to the rear yard storm sewer and drainage system. The proposed changes include <br />moving the storm sewer approximately 5 feet away from the building pad, and the associated <br />portion of the drainage and utility easement be vacated. The developer’s engineer has <br />submitted the proposed storm sewer design modification and easement vacation which was <br />reviewed and approved by City staff. <br /> <br />The proposed easement vacation is to accommodate Sharper Homes request for their semi- <br />custom home proposed on Lot 2 Block 1 of St. Clair Estates. An Ordinance is required to <br />vacate the easement and the City Council is to hold public hearings for the vacation. <br /> <br /> <br />
