7 <br /> <br />A and B include the private drives common open space. These parcels will be owned and <br />maintained by the HOA. Outlot C will include stormwater ponds, infiltration areas and wetland <br />buffers. The applicant is proposing that this outlot be deeded to the City but, prior to final plat <br />submittal, the City and the applicant should work together to determine whether the City has an <br />interest in owning the property rather simply obtaining an easement. <br /> <br />The applicant has indicated that the project will likely be built in 2 phases. A phasing plan will <br />be submitted for City review and approval prior to the final plat approval. <br /> <br />Park Dedication <br /> <br />Park dedication shall be cash in lieu of land at $2,500 per unit ($280,000 total for 112 units). <br /> <br />Additionally, the City is working with Anoka County Parks to development a playground south <br />of Outlot C. <br /> <br />Ordinance Amendment <br /> <br />As noted in the staff report, there are several areas where the applicant is proposing to amend the <br />Lino Lakes Town Center Design & Development Guide standards. The Town Center PUD was <br />approved by Ordinance 04-04 and any change to the design standards will require an amendment <br />to the PUD. In summary, the applicant is requesting the following amendments: <br /> <br />1. To allow only one building type in the development. <br /> <br />2. To allow 4’ x 8’ porches where 6’ x 10’ porches are required. <br /> <br />3. To allow street-facing facades with less than 25% window area. <br /> <br />4. To eliminate the requirement that windows and doors must be recessed at least two <br />inches from walls or exterior trim to create a shadow line for visual interest. <br /> <br />5. To allow vinyl siding. <br /> <br />6. To eliminate the maximum 15 foot secondary street frontages requirement. <br /> <br />7. To allow a single user sign with the development name in the common area. <br /> <br /> <br />Findings of Fact <br /> <br />The following are Findings of Fact as related to the land use decisions for the PUD Development <br />Stage Plan/Preliminary Plat and text amendment. <br /> <br />Per Section 1007.024(1) Purpose and Intent, the PUD, by allowing deviation from the strict <br />provisions of this Ordinance related to setbacks, heights, lot area, width and depths, yards, etc.,
