CITY OF LINO LAKES RESOLUTION NO. 1 3 -30 APPROVING AN EXTENSION OF TIME FOR SUBMITTAL OF THE PLANNED UNIT DEVELOPMENT FINAL PLAN AND FINAL PLAT FOR PRESERVE AT LINO LAKES WHEREAS, on August 28 and September 11 , 2006 the City Council gr anted approvals for the The Preserve project with the following actions: -Ordinance 08 -06: Rezone to Planned Unit Development (PUD) -Resolution 06 -137: PUD Development Stage Plan/Preliminary Plat and WHER E AS, Section 2, Subd. 10.F.8.g. of the City’s Zo ning Ordinance, requires that a PUD - final plan be submitted within one year of approval of the PUD Development Stage Plan/Preliminary Plat but allows an extension for six month intervals, and the extension can be approved after the deadline date passes ; an d WHER E AS, Section 1001.055 of City Code (Subdivision Regulations) requires a final plat be submitted within one year of approval of the preliminary plat unless an extension is requested and for good cause is granted by the City Council; and WHEREAS, the City granted extensions with Resolutions 08 -109 , 09 -77 , 10 -34 , 10 -86 , 11 -30 , 11 -85 , 12 -14 and 12 -87 ; and WHEREAS, a request has been submitted to the City for additional extension; and WHEREAS, the City Council finds that there is good cause to grant an extension because the economic conditions of the real estate market have affected development nationally, regionally, and locally; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lino Lakes hereby approves an extension for submittal o f the PUD Final Plan/Final Plat application for the Planned Unit Development originally approved with Resolution No. 06 -137. BE IT FURTHER RESOLVED, that the following conditions apply: 1. The PUD Final Plan/Final Plat application must be submitted by Octob er 1 , 201 3 . 2. All of the conditions of approval included in Resolution No. 06 -137 continue to apply. Adopted by the Council of the City of Lino Lakes this day of , 201 3 .
