CITY COUNCIL <br />AGENDA ITEM 1 F <br /> <br /> <br />STAFF ORIGINATOR: Michael Grochala <br /> <br />MEETING DATE: March 11 , 201 3 <br /> <br />TOPIC: Consideration of Resolution No. 1 3 -31 <br /> Extension of Time for Main Street Village <br /> <br />VOTE REQUIRED: 3/5 <br /> <br /> <br />INTRODUCTION <br /> <br />In February of 20 08, the City Council approved the Main Street Village project, including: <br />• Conditional Use Permit for a Planned Unit Development (PUD) Development Stage <br />Plan/Preliminary Plat (Resolution No. 08 -17); and <br />• Conditional Use Permit for a Motor Fuel Station (Resol ution 08 -18); and <br />• Conditional Use Permit for Commercial Car Wash (Resolution 08 -19) <br /> <br />The site has not been developed, but the owner is still interested in pursuing the project. <br /> <br />BACKGROUND <br /> <br />A PUD Development Stage Plan must be followed by the Final Plan application within twelve <br />months under the zoning ordinance. Likewise, a final plat must be submitted within one year of <br />the preliminary plat approval under the subdivision regulations. For a conditional use permit <br />(CUP), construction must begin within one year of approval. Extensions have been granted by <br />the City Council through Resolutions 09 -76 , 10 -33 , 10 -77 , 11 -29, 11 -84 , 12 -13 , and 12 -86 . A <br />PUD can be extended for a period of six months under the zoning ordinance. The current <br />submittal deadline f or the PUD and CUP’s is April 1, 201 3 , and the recommendation is to extend <br />it to October 1, 2013 . <br /> <br />When built, t his project would provide new commercial tax revenue near the I -35E interchange. <br />However, the economic conditions of the real estate market hav e affected development timelines <br />nationally, regionally , and locally. <br /> <br />RECOMMENDATION <br /> <br />Approve Resolution No. 1 3 -31 granting extensions for submitting the PUD Final Plan/Final Plat <br />and for construction to begin on the motor fuel station and carwash for M ain Street Village . <br /> <br /> <br />ATTACHMENTS <br /> <br />1.
