Consider Resolution No. 13-27, Approving Development <br />Ag reement, Forest View Acres 2 nd Addition <br /> <br />VOTE REQUIRED : 3/5 <br /> <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consideration of the Final Plat and Development Agreement for <br />Forest View Acres 2 nd Addition. <br /> <br />REVIEW DEADLINE: Application Deemed Complete - January 18, 2013 <br /> 60 - Day Review Deadline - March 19, 2013 <br /> <br />B ACKGROUND <br /> <br />The City Council approved the preliminary plat for Forest View Acres 2 nd Addition, formerly <br />known as Rademacher Addition, on December 10, 2012 with Resolution No. 12-129. Forest <br />View Acr es 2 nd Addition is a 2-lot commercial subdivision on the NE corner of Lake Drive and <br />Main Street. <br /> <br />The final plat is consistent with the approved preliminary plat. The City Attorney has reviewed <br />the title commitment. The City Engineer has prepared the development agreement. All other <br />conditions of preliminary plat approval have been addressed or are otherwise provided for in the <br />development agreement. <br /> <br />The Development Agreement provides for the submittal of fees and securities to cover City <br />review cost s and ensure completion of the public and private improvements in accordance with <br />the approved plans. The agreement also requires the submittal of the following documents: <br /> <br />1. A Declaration for Maintenance of Storm Water Facilities must be executed for the <br />s torm water treatment facilities located on the site in the form of Exhibit A, <br />attached hereto. <br /> <br />2. A Quit Claim Deed in favor of the City must be prepared and recorded for the <br />trail easement along Lake Drive.
