WHEREAS , at their meeting on March 13, 2013 , the Planning & Zoning Board recommended app roval of the planned unit developm ent – final plan /final plat subject to certain conditio ns of approval ; and WHEREAS , the proposed planned unit development – final plan /final plat meets the requirements of the City’s zoning ordinance and subdivision ordin ance, subject to certain conditions of approval. NOW, THEREFORE, BE IT RESOLVED by T he City Council of The City of Lino Lakes that the planned unit d evelopment – final plan /final plat for Preserve at Lino Lakes is hereby approved subject to the following conditions: 1. The developer shall submit an executed development agreement and all documents, fees and securities required therein prior to release of the signed Final Plat. 2. The developer shall record the plat within 90 days after the date of approval, othe rwise the approval of the final plat shall be considered void, unless the developer requests and receives an extension from the City Counci l . 3. A revised Conservation Easement, Cove nants & Restrictions (CECR) shall be submitted to the City in recordable form at . 4. Homeowners Association documents shall be submitted to the City in recordable format including Bylaws and Articles of Incorporation. 5. A Grading Permit application shall be submitted and approved by City Staff prior to any grading or site work. 6. A quit cl aim deed for conveyance of Outlot A to the City in recordable format shall be submitted by the developer. 7. A Sign Permit including maintenance plan and easement agreement for any area (subdivision) identification signs shall be submitted and approved by the City prior to sign installation. 8. The “The Preserve Conservation Development; Restoration and Management Plan for Conservation Areas” shall be revised and approved by City staff. 9. The "Preserve of Lino Lakes" development has protection areas for Tubercled R ein - orchid, an endangered species, and Scirpus clintonii, a special concern bulrush. Scirpus clintonii is soon to be placed on the endangered list. These areas are to be set aside and protected from construction damage. a. Orange fencing with appropriate signage must be placed at the boundaries of these areas. b. Signage must state no equipment or disturbances of any kind allowed in the protection areas. c. Attention to these areas must be discussed at preconstruction meetings, and sufficient notice to appro priate city staff given of the commencement of grading operations. 10. A temporary cul de sac easement on Pheasant Run is required. 11. Construction details for boardwalks shall be submitted to the City for approval. 12. All additional comments from City Engineer Lett er dated May 1, 2013 shall be addressed.
