<br />WS – Item # 4 <br /> <br />WORK SESSION STAFF REPORT <br />Work Session Item No. 4 <br /> <br />Date: June 3, 2013 <br /> <br />To: City Council <br /> <br />From: Michael Grochala <br /> <br />Re: Lino Lakes Assisted Living Update <br /> <br />Background <br /> <br />The City has been working with Lino Lakes Assisted Living to facilitate expansion of <br />their existing facility on a portion of the Legacy at Woods Edge property. The City has <br />previously agreed to the purchase of the property and corresponding conveyance to the <br />the owners for the expansion. The City has also approved the Final Plat and Final Plan <br />for the property. <br /> <br />City staff and the City Engineer, WSB and Associates have also been working with the <br />applicant to meet the stormwater management requirements of the Rice Creek Watershed <br />District. The RCWD requirements have changed since the original approval of the <br />Legacy development and require additional stormwater treatment that was not originally <br />anticipated . We are currently working with the developer on a variance application for <br />submittal to the watershed district for their consideration in June. <br /> <br />Staff is also working with the developer on a possible modification to the site plan to <br />change the location of the access drive onto Town Center Parkway. The current plan <br />calls for a new access on the southeast side of the propert y. This access is located <br />approximately 5 feet from a neighboring property access point and requires the relocation <br />of City utilities, a street light, and disturbance to the existing roadway. The existing <br />access to the east was originally intended to se rve both the Assisted Living site and the <br />adjacent townhome property. The joint access was not considered with the approved <br />plans because the city did not own the property. <br /> <br />With the approval of the special legislation the City will soon hold fee title to the abutting <br />property and would be in a position to grant an access easement in favor of the Assisted <br />Living property. This would allow the driveway to be shifted and avoid the expense and <br />disturbance associated with creating a new access point. <br /> <br />Req uested Council Direction <br /> <br />Staff is seeking council interest in providing an access easement across adjacent property. <br /> <br />Attachments <br /> <br />1.
