CITY OF LINO LAKES <br />RESOLUTION NO. 18-49 <br />RESOLUTION APPROVING THE FINAL PLAT <br />FOR NORTHPOINTE 7TH ADDITION <br />WHEREAS, the City received an application for Final Plat approval for NorthPointe 7th <br />Addition hereafter referred to as "Development"; and <br />WHEREAS, City staff completed review of the proposed "Development" based on the <br />NorthPointe 7th Addition Sanitary Sewer, Watermain, Storm Sewer and Street <br />Construction plan set and final plat dated March 2, 2018 and prepared by Carlson <br />McCain; and <br />WHEREAS, a public hearing was held before the Planning & Zoning Board on <br />December 11, 2013 and continued to the February 12, 2014 meeting and the Board <br />recommended approval of the PUD Development Stage Plan/Preliminary Plat; and <br />WHEREAS, the City Council approved the rezoning from R, Rural to PUD, Planned <br />Unit Development with Ordinance No. 02-14 and the PUD Development Stage <br />Plan/Preliminary Plat with Resolution No. 14-21; and <br />WHEREAS, Planning & Zoning Board reviewed and recommended approval of <br />NorthPointe 7th Addition Final Plat on April 11, 2018; and <br />WHEREAS, the proposed development is not considered premature and meets the <br />performance standards of the subdivision and zoning ordinance; and <br />WHEREAS, the Final Plat substantially conforms to the PUD Development Stage <br />Plan/Preliminary Plat. <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino <br />Lakes hereby makes the following: <br />FINDINGS OF FACT <br />1. The final plat substantially conforms to the approved preliminary plat subject to the <br />conditions listed below. <br />2. The City Attorney approved the status of title/property ownership related to the <br />final plat subject to the conditions listed below. <br />3. A Development Agreement has been completed. <br />4. Conditions attached to approval of the preliminary plat have been fulfilled or <br />secured by the Development Agreement. <br />5. All fees, charges and escrow related to the preliminary or final plat have been paid <br />in full. <br />
