CITY OF LINO LAKES <br />RESOLUTION NO. 18-76 <br />Finding Violations of the City Code and Imposing Penalties Against <br />Don Julio's Mexican Restaurant <br />WHEREAS, the Public Safety Department of Lino Lakes conducted a compliance check on <br />November 21, 2017 in which one liquor violation occurred. On February 18, 2018 there were <br />two additional liquor violations by two separate employees; and <br />WHEREAS, it is alleged that Don Julio's Mexican Restaurant violated the Lino Lakes Code of <br />Ordinances, Section 702, by selling alcohol to a person underage; and <br />WHEREAS, the City Council of Lino Lakes conducted a violation hearing on June 11, 2018, at <br />6:00 p.m. and reached a finding that violations did occur; and <br />WHEREAS, the City Council has reviewed a Best Practices Grid that includes <br />recommendations for civil penalties; and <br />WHEREAS, the recommended penalty under the Best Practices Grid is as follows: <br />1. $2,000 civil penalty and 10 day suspension to sell intoxicating liquor <br />NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino Lakes <br />hereby adopts this Resolution No. 18-76 finding that a violation of the City Code has occurred <br />and imposing a penalty against Don Julio's Mexican Restaurant of a $2,000 fine and 10 day <br />suspension to sell intoxicating liquor. <br />BE IT FURTHER RESOLVED that any suspension imposed by this resolution shall be <br />effective as of the opening of the business (Don Julio's Mexican Restaurant) on June 18, 2018 <br />and remain in effect until the close of the business on June 27, 2018. <br />BE IT FURTHER RESOLVED that any monetary civil penalty imposed by this resolution <br />shall be due in full by 4:30 p.m. on June 25, 2018. <br />Adopted by the Council of the City of Lino Lakes this 11th day of June, 2018. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />Manthey and was duly seconded by Council Member Maher and upon <br />vote being taken thereon, the following voted in favor thereof: <br />Manthey, Maher, Rafferty, Stoesz, Re <br />The following voted against same: <br />none <br />Jeff Reinert, <br />
