CITY OF LINO LAKES RESOLUTION NO. 18-'1 RESOLUTION DENYING AN APPLICATION FOR A THERAPEUTIC MASSAGE BUSINESS LICENSE AND MASSAGE THERAPIST LICENSE (INDIVIDUAL) WHEREAS, the City received an application for a Therapeutic Massage Business License for Dongmei, Inc. at 560 Lilac Street, and an application for an Individual Therapeutic Massage License for Dong Mei Qiu; and WHEREAS, the Lino Lakes Public Safety Division has conducted a background check on the applicant; and WHEREAS, City administration and building staff has completed a review of the applications; Based on the record before it, the City Council of the City of Lino Lakes hereby makes the following: FINDINGS Lino Lakes City Code, Section 616.04(b), states that an applicant shall furnish to the city the applicant's interest in the premises. No statement of interest in the premises has been provided. Lino Lakes City Code, Section 616.05, Subd. 3, states that an applicant must provide information reasonably necessary for the issuance of the license. Applicant has provided a transcript from a school but has not provided an address of residence for the timeframe for the purpose of background investigation. Lino Lakes City Code, Section 616.05, Subd. 5, states that premises must be approved for occupancy and use by appropriate city personnel and must be in compliance with all applicable laws and ordinances. A change of use permit has not been approved by the city for the premises. Lino Lakes City Code, Section 616.06, Subd. 3, states that an applicant will be considered by the city council unless they have been determined to have engaged in any conduct prohibited by Minnesota Statutes, Section 146A.08 within five years of the date of their application. The Public Safety Department's report, dated July 18, 2018, on the background investigation for the applicant includes reports of the applicant's engagement in prohibited conduct. BASED ON THESE FINDINGS, the City Council hereby denies the applications of Dong Mei Qiu to operate a Therapeutic Massage Business at 560 Lilac Street and application for an Individual Therapeutic Massage License. 1
