CITY OF LINO LAKES RESOLUTION NO. 13 -81 RESOLUTION AMENDING JOINT POWERS A GREEMENT WITH TOWN OF WHITE BEAR AND CITY OF NORTH OAKS PROVIDING FOR PUBLIC WATER AND SANITARY SEWER SERVICE WHEREAS, Minnesota Statutes, Section 471.59, authorizes political subdivisions to enter into Joint Powers Agreements, and WHEREAS, the City of L ino Lakes, City of North Oaks and the Town of White Bear entered into a Joint Powers Agreement for the purpose of providing public utilities to the Rapp Farm development in North Oaks in 2004, and WHEREAS, North Oaks Company, LLC, a Minnesota limited lia bility company has proposed to extend the service area of the utilities within the City of North Oaks, and WHEREAS, The Joint Powers Agreement requires that any extensions of the service area be set forth in an Addendum to the agreement, and WHEREAS, the City of Lino Lakes finds that it is in the best interests of the community to cooperate with North Oaks and the Town on the extension of Town sewer and water lines in order to serve the Rapp Farm development in North Oaks. NOW, THEREFORE BE IT RESOLVED b y The City Council of The City of Lino Lakes that the amendment to the Joint Powers Agreement with the City of North Oaks and the Town of White Bear is hereby approved and the Mayor and City Clerk are authorized to sign the agreement on behalf of the City. Adopted by the Council of the City of Lino Lakes this 8 th day of July, 2013.
