CITY COUNCIL AGENDA ITEM 3B STAFF ORIGINATOR: Lisa Hogstad -Osterhues , Deputy City Clerk MEETING DATE: July 22 , 201 3 TOPIC : Consider Resolution No. 1 3 -83 , Authorizing issuance of a special event permit and 1 -4 day temporary on sale liquor license for the American Legion Post 566 Blue Heron Days Family Picnic VOTE REQUIRED: Simple Majority (3/5 Vote Required) BACKGROUND : American Legion Post 566 has scheduled a special event for Friday , August 1 6 and Saturday, August 17 during the weekend of the Blue Heron Days festival. The outdoor event plans include barbeque and beverag es . The Legion would like to fence off a portion of their property on the south and east side of their building to b e used for pic nic festivities for these events only . The Minnesota Alcohol and Gambling Enforcement Division r e quires a 1 to 4 Day Temporary On -Sale Liquor License to allow the consumption of alcohol in this outdoor area. The applicant is required to submit their request to the C ity requesting local approv al before the application is submitted to the state for final consideration. The Legion has submitted to the City an application for both a special event permit and temporary liquor license. The applications have been reviewed by staff, including the p olice and fire dep artments, and the applicant has been provided with a list of sa fety conditions . The applicant has agreed to comply with the conditions and to address any other safety considerations that may arise. Therefore, staff is presenting for cit y council consideration a resolution authorizing the issuance of a special event permit and temporary liquor license to American Legion Post 566.
