WS –Item#1 <br />WORK SESSION STAFF REPORT <br />Work Session Item No.1 <br />Date: <br />September 3, 2013 <br />To: <br />City Council <br />From: <br />Michael Grochala <br />Re: <br />7309 Lake DriveCode Enforcement –Exterior Storage <br />Background <br />The City Council discussed this issue at the May5, 2013, June 3, 2013and August 5, <br />2013work sessions.At May meeting council requested that the property owner evaluate <br />the business plan for the site and determine if any changes could be made to bring the site <br />into compliance with the zoning code. <br />As discussed at the June meeting staff received a letter from Mobile Mini, Inc., dated <br />May 29, 2013. Mobile Miniis the lessee of the site. The letter did not include any <br />proposed change to the site operations but rather contended that they should be allowed <br />to remain as a legal nonconforming use. <br />Staff reviewed the letter and their stated position with the City Attorney. A response <br />letter was sent on July 16, 2013 from Joe Langel, City Attorney reiterating that the use of <br />the property for outside storage is not grandfathered in. The letter provided 14 days to <br />provide us with information on how they intend to modify the use to bring it into <br />compliance with the zoning ordinance. <br />At the August 5 work session the reiterated lack of interest in amendingthe zoning <br />ordinance and directed staff to continue code enforcement activities. On August 6, 2013 <br />staff met with the property owner, a representative from Mobile Mini, and representatives <br />from Lorenz Bus Service, a prospective buyer of the property. Noresolution to the issue <br />was reached at the meeting. Mobile Mini indicated they would review their situation and <br />possibly request and extension of time to allow for further review of options. <br />The property owner has since requested an opportunity to speakto the council directly <br />regarding this matter. <br />Staff has not received any additionalinformation from the lessee or the property owner. <br />Requested Council Direction <br />Staff is requesting City Council direction on the code enforcement issue. <br /> <br />
