1 <br />CITY COUNCIL <br />AGENDA ITEM 6D <br /> <br />STAFF ORIGINATOR: Diane Hankee, City Engineer <br /> <br />MEETING DATE: February 25, 2019 <br /> <br />TOPIC: Consider Resolution No. 19-18: Approve License for <br />Utility to Cross Agreement with Minnesota DNR, West <br />Shadow Lake Area Improvement Project <br />VOTE REQUIRED: 3/5 <br />INTRODUCTION <br />Staff is requesting City Council Approval of the License for Utility to Cross Public Waters <br />Agreement with the Minnesota Department of Natural Resources (DNR). The Agreement is for a <br />watermain crossing between Rice Lake and Reshanau Lake. <br />BACKGROUND <br /> <br />The West Shadow Lake Area Improvement Project includes the installation of watermian <br />and roadway improvements between Rice Lake and Reshanau Lake. These lakes are <br />waterbodies of the State and the work requires an agency to agency Agreement. <br /> <br />The purpose of the license between the Minnesota DNR and the City of Lino Lakes <br />(Licensee) would be, “Construction, maintenance and operation of a liquids pipeline <br />under water under the covenants and agreements of the Licensee…” This license allows <br />the City of Lino Lakes to install and maintain the watermain that affects DNR waters. <br />The license would last for 50 years, and expire in January, 2069. At that point, the <br />License would be renewed. The cost of the license is $293.00 and the cost is planned to <br />be incorporated into the costs of the project. <br /> <br />RECOMMENDATION <br /> <br />City Staff recommends approval of Resolution No. 19-18, Approve License for Utility to <br />Cross Public Waters Agreement with Minnesota DNR, West Shadow Lake Area <br />Improvement Project <br /> <br />ATTACHMENTS <br /> <br />1.
