WATER TOWER LEASE AGREEMENT <br /> THIS WATER TOWER LEASE AGREEMENT (the “Agreement”) effective the <br />_____ day of _______, 2018 (“Effective Date”), between the City of Lino Lakes, <br />Minnesota (“Owner”), and Verizon Wireless (VAW) LLC d/b/a Verizon Wireless <br />(“Tenant”). <br /> WHEREAS, Owner is the owner of certain real property, located at 7470 Fourth <br />Avenue, Lino Lakes, Minnesota, on which the Owner constructed, owns, and maintains a <br />water tower (“water tower”); and <br /> WHEREAS, Tenant currently leases both interior space in, and exterior space on, <br />the water tower, as well as ground space adjacent to the water tower, all pursuant to a Site <br />Lease Agreement dated February 14, 2000 between Owner and AirTouch <br />Communications, Inc., d/b/a AirTouch Cellular, as Tenant’s predecessor-in-interest; as <br />amended by that certain Amendment No. 1 to Site Lease Agreement dated November 1, <br />2007 between Owner and Tenant; and as as further amended by that certain Amendment <br />No. 2 to Site Lease Agreement dated May 30, 2008 between Owner and Tenant <br />(collectively, the “Prior Lease”); and <br /> WHEREAS, the parties agree and acknowledge that the Prior Lease will expire on <br />December 31, 2019; and <br /> WHEREAS, the parties desire to enter into this Agreement to allow Tenant to <br />continue leasing such space upon expiration of the Prior Lease in order to operate <br />Telecommunications equipment located within, upon and adjacent to the water tower, as
