<br />Anoka County Contract No. __________ <br /> <br />JOINT POWERS AGREEMENT <br />BETWEEN ANOKA COUNTY AND THE CITY OF LINO LAKES <br />FOR CONSTRUCTION OF A CUL-DE-SAC ON WEST SHADOW LAKE DRIVE <br />WITH TRAILHEAD FOR RICE CREEK CHAIN OF LAKES REGIONALTRAIL <br /> <br />This Joint Powers Agreement (JPA) is made and entered into this ____ day of <br />______________, 2018, by and between the County of Anoka, a political subdivision of the <br />State of Minnesota, 2100 Third Avenue, Anoka, Minnesota 55303 ("County”) and the City of <br />Lino Lakes, a municipal corporation under the laws of the State of Minnesota, 600 Town Center <br />Parkway, Lino Lakes, Minnesota, 55014 (“City”). <br /> <br />WITNESSETH <br /> <br />WHEREAS, access to parks, trails, and recreation areas are essential to the quality of <br />life, health, and welfare of the City, the County, and the region; and <br /> <br />WHEREAS, the City plans to reconstruct West Shadow Lake Drive, which sits adjacent <br />to the Chomonix Golf Course property owned by County of Anoka and abuts certain park land; <br />and <br /> <br />WHEREAS, the road improvements will include extending the existing dead-end road <br />with a cul-de-sac at the end of West Shadow Lake Drive, which will provide an improved parking <br />area and connection to the neighboring Bunker-Chain of Lakes Regional trail (collectively the <br />“Project”); and <br /> <br />WHEREAS, the proposed cul-de-sac will be constructed on County Park property, for <br />which the City requires temporary and permanent easements from the County; and <br /> <br />WHEREAS, in connection with the Project, the City agrees to vacate a portion of city <br />roadway, up to and including an existing cul-de-sac on Sandpiper Road, which is adjacent to the <br />improvements that will take place on West Shadow Lake Drive. <br /> <br />WHEREAS, it is in the interest of each jurisdiction to collaborate in this Project regarding <br />the road configuration and trail facilities, which benefit both local and county area residents; and <br /> <br />WHEREAS, Minn. Stat. § 471.59 authorizes political subdivisions of the State to enter <br />into joint powers agreements for the joint exercise of powers common to each. <br /> <br />NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED AS FOLLOWS: <br /> <br />I. PURPOSE <br /> <br /> The parties have joined together to enable the City to reconstruct West Shadow <br />Lake Drive, including installation of a cul-de-sac, which will provide parking areas and serve as <br />a trailhead to the nearby regional trail. The parcels and land areas involved in the Project are
