1 <br /> <br />CITY COUNCIL <br />AGENDA ITEM 6C <br /> <br /> <br />STAFF ORIGINATOR: Diane Hankee PE, City Engineer <br /> <br />MEETING DATE: September 24, 2018 <br />TOPIC: Drainage and Utility Easement Vacation <br />i) Consider 2nd Reading of Ordinance No. 11-18, Vacating <br />Drainage and Utility Easement 440 Park Court <br /> *Council may vote to dispense with the full reading of the ordinance <br /> *Roll call vote is required for adoption of the ordinance <br /> <br />ii) Consider Resolution No. 18-116, Approving Summary <br />Publication of Ordinance No. 11-18 <br /> <br />VOTE REQUIRED: 4/5 <br /> <br />INTRODUCTION <br /> <br />Staff is requesting City Council consideration of the 2nd Reading of Ordinance No. 11-18, <br />vacating a portion of the drainage and utility easements originally dedicated on Lot 4, Block 1, <br />Marshan Lake Industrial Park, Anoka County, Minnesota. <br /> <br />BACKGROUND <br /> <br />440 Park Court is the future site for Lino Lakes Storage. The applicant is requesting a portion <br />of the existing drainage and utility easement be vacated and replaced by a new drainage and <br />utility easement boundary for a future pond. The easement proposed to be vacated was <br />originally over a wetland. An approved wetland delineation was performed with the Lino <br />Lakes Storage project showing this area is no longer a wetland and thus can be vacated. <br /> <br />The Drainage and Utility Easement Vacation Description Sketch prepared by E.G. Rud & Sons, <br />Inc. on July 26, 2018 detailing the proposed drainage and utility area to be vacated is enclosed. <br /> <br />RECOMMENDATION <br /> <br />Staff is recommending approval of the 2nd Reading of Ordinance No. 11-18 Vacating Drainage <br />& Utility Easement, 440 Park Court, and approval of Resolution No. 18-116, Approving <br />Summary of Publication of Ordinance No. 11-18. <br /> <br />ATTACHMENTS <br /> <br />1.
