7 <br /> <br />Wetlands <br /> <br />Wetland delineations were approved by RCWD and USACE in 2015. The delineation <br />identified 28 wetlands totaling approximately 20 acres in size. The original approved WCA <br />Sequencing Application proposed wetland impacts, wetland creation, wetland restoration and <br />upland buffer establishment. In April 2018, the developer revised the application to purchase <br />3.3671 acres of wetland banking credits as the proposed compensatory mitigation action. <br /> <br />The 3.3671 acres of wetland fill, impacts and mitigation (wetland bank credits) occur with the <br />Phase I grading limits. As previously noted, a Conservation Easement and Declaration <br />establishing wetland buffer (both favor of RCWD) have been recorded over Wetland 17. <br />“Protected Open Space Area” signs are located along the wetland buffer. When the lots <br />abutting this buffer are graded in the future, these signs will be located along the rear lots lines. <br /> <br />The establishment of the greenway corridor including wetlands, trails and open space on the <br />north end of the Watermark development is a critical component of the project and will be <br />developed in future phases. The Master Development Agreement details the timing, <br />establishment and management of that corridor. <br /> <br />Development Agreement <br /> <br />Master Development Agreement <br /> <br />Unique to the Watermark development is the requirement of a Master Development <br />Agreement. This Agreement covers the entire 372 acre site and Lennar, Mattamy Homes and <br />the City of Lino Lakes are parties to it. The Agreement details the terms and conditions of City <br />approvals, the Development Plans, the required public and private improvements as part of the <br />first and subsequent phase, the standards for the timing and financing of the improvements, <br />required HOA documents and the terms of payment. <br /> <br />The City Attorney, city staff, Lennar, and Mattamy Homes have negotiated the terms of the <br />Master Development Agreement. The Agreement shall be approved by City Council. <br /> <br />Development Agreement and Planned Unit Development Agreement <br /> <br />The City will also require our standard Development Agreement specific to each phase of <br />development. This agreement further details required improvements and securities. The City <br />Engineer has drafted this Agreement and it shall be approved by the City Council. <br /> <br />Title Commitment <br /> <br />The City Attorney has received the title commitment and final plat and will provide comments <br />prior to final plat approval. <br /> <br />Stormwater Maintenance Agreement <br /> <br />A Declaration for Maintenance of Stormwater Facilities for Ponds 100, 200, 300 and 20 was <br />recorded on September 10, 2018.
