1 <br /> <br />WS – Item #7 <br />WORK SESSION STAFF REPORT <br />Work Session Item No. 7 <br /> <br />Date: March 4, 2019 <br /> <br />To: City Council <br /> <br />From: Michael Grochala, Community Development Director <br /> <br />Re: Zoning Ordinance Update – Amendment Considerations <br /> <br />Background <br /> <br />Multiple Buildings on Single Lot in Commercial, Industrial Properties. <br />Current City ordinance only allows for one principal building per parcel. In commercial <br />and industrial zoning districts only 1 accessory building is allowed and limited to 400 <br />square feet. <br />Accordingly any commercial or industrial expansion project which requires an additional <br />building in access of 400 square feet would require approval of a planned unit <br />development. PUD’s may be done by rezoning in Industrial Districts and by either <br />rezoning or Conditional Use Permit in Commercial Districts. For a single use site, <br />approval for multiple buildings may be more appropriately handled through a Conditional <br />Use permit process. <br />City staff is proposing an ordinance change to simplify the process for single use <br />expansion projects and minimize the use of the Planned Unit Development process. <br />The Planning and Zoning Board supported consideration of the change and a public <br />hearing has been scheduled for March 13, 2019. <br />Retaining Walls <br />City Code §1007.043 (18) (d)(5) currently prohibits retaining walls over 42 inches in <br />height. A zoning permit is required for anything 42 inches or less. <br />The state building code has provision for walls 48 inches and greater. Staff is proposing <br />to allow the higher wall height subject to State Building Code provisions. Staff also is <br />proposing a permit exception for retaining walls of a certain maximum height. We are <br />currently considering 24”. <br />The Planning and Zoning Board supported consideration of the change and a public <br />hearing has been scheduled for March 13, 2019. <br />Exterior Storage <br />City Code §1007.043 (16)(a) regulates Exterior Storage in rural or residential zoning <br />districts on properties ten (10) acres in size or less. There are no prohibitions regarding <br />exterior storage on parcels over 10 acres.
