THE VILLAGE OF LINO LAKES <br />ORDINANCE NO. 10 <br />An Ordinance defining certain misdemeanors and prescribing a penalty <br />for violation thereof. <br />The Village Council of the Village of Lino Lakes ordains: <br />Section 1. The doing of any of the acts or things prohibited or the <br />failing to do any of the things or acts commanded to be done as set <br />forth in this ordinance is hereby declared to be an offense against the <br />good order, public peace, morale,health, welfare and proper government <br />of this village and unlawful. Any person, firm or corporation convicted <br />of violating any of the provisions of this ordinance shall be deemed <br />guilty of a misdemeanor and punished by a fine of not less than one <br />do]1ar nor more than one hundred dollars or by imprisonment in the <br />village jail at hard labor or otherwise at the discretion of the Judge <br />for not less than one day nor more than three months, together with <br />the costs of prosecution in either case, and in default of payment of <br />fine or costs, the person committed shall be confined in such jail an <br />additional number of days equal to the number in dollars of fine or costs <br />assessed, and not to exceed three months. <br />(a) Every person who, by force or fraud, shall rescue from lawful <br />custody, or from an officer or person having him in lawful custody, <br />a prisoner held upon a charge, arrest, commitment, conviction, or <br />sentence for a misdemeanor, shall be guilty of a misdemeanor. <br />(b) Every person who shall take from the custody of an officer or <br />other person personal property in his charge under any process of <br />law or who shall wilfully injure or destroy such property, shall be <br />guilty of a misdemeanor. <br />(c) Every prisoner who shall escape from custody, or who shall <br />depart from the jail without permission, or shall fail to return in <br />accordance with his permission, shall be guilty of a misdemeanor. <br />(d) Every person who with intent to effect or facilitate the escape <br />of a prisoner, whether such escape shall be effected or attempted or <br />not, shall enter the jail or convey to a prisoner any information <br />or send into the jail any disguise, instrument, weapon or other thing, <br />and every person who shall aid or assist a prisoner in escaping or <br />attempting to escape from lawful custody shall be guilty of a mis— <br />demeanor. <br />
