ORDINANCE NO. 25 <br />VILLAGE OF LINO LAKES <br />ANOKA COUNTY, MINNESOTA <br />AN ORDINANCE LICENSI:G AND REGULATING THE KEEPING OF DOGS, PROVIDING FOR THE <br />LICENSING OF DOG KENNELS AND REPEALING ORDINANCE NO. 16. <br />The Village Council of the Village of Lino Lakes, Minnesota do ordain as <br />follows: <br />SECTION 1. Running at large prohibited. No dog shall be permitted to run <br />at large within the limits of this village. ' <br />SECTION 2. Control of dogs, The restriction imposed by Section 1, shall <br />not prohibit the appearance of any dog upon the streets or public property when <br />the dog is under the immediate control of the person charged with its care. <br />SECTION 3. License required. No person shall keep any dog within the <br />Village without securing a license therefrom the Clerk, who shall keep a record <br />of all licenses issued and shall issue a metal tag for each license. The annual <br />license fee shall be $2.00 for each male dog or spayed female dog and $5.00 <br />for each female dog. Licenses heretofore issued and licenses issued hereafter <br />shall expire on the 1st day of January next following their issuance. <br />SECTION 4. Impounding. The dog catcher, every constable and every police <br />officer shall impound any dog found unlicensed or running at large and shall <br />give notice of the impounding to the owner of such dog, if known. In case the <br />owner is unknown, such officer shall post notice at the Village polling place, <br />that if the dog is not claimed within 4 days of the posting of the notice, it <br />will be disposed of. If such dog is not claimed within the time specified and <br />all fees and charges paid, the dog catcher or any constable or those directed <br />by them shall dispose of such dog unless it is requested by a licensed education— <br />al or scientific institution under Minnesota Statutes 35.71. The dog catcher <br />or constable or their subordinates shall cause any dog impounded to be housed <br />and fed in a humane manner. An impounding fee of $3.00 and a charge of $.75 <br />per day for feeding shall be charged for any dog impounded. <br />SECTION 5. Kennel. No person, firm or corporation shall harbor, maintain, <br />or keep for pleasure or profit, four (4) or more dogs without securing a license <br />therefore from the Village Clerk. The license fee shall be $50.00 per year. <br />This fee shall be in lieu of the license fee prescribed in the preceding sections <br />for each dog kept in such kennel. No kennel license shall be issued by the <br />Clerk unless the applicant therefore has complied with the zoning ordinances of <br />this Village. Kennel licenses shall expire on the 1st day of January next <br />following their issuance. The Clerk shall keep a record of all kennel licenses <br />issued and shall issue a written receipt for each license issued. <br />SECTION 6. Penalty. Any person, firm, or corporation violating any pro— <br />visions of this ordinance shall be guilty of a misdemeanor and upon conviction <br />thereof shall be punished by a fine of not more than $100.00 or by imprisonment <br />in Village or County jails for not more than 90 days. <br />SECTION 7. Repeal. Ordinance No. 16, passed February 27, 1956, is hereby <br />repealed. <br />SECTION S. Effective date. This ordinance shall be in full force and <br />effect from and after its passage and publication according to law. <br />Passed by the Village Council this 13th day of June, 1960. <br />/s/ Arnold A.
