ORDINANCE NO. 59 <br />VILLAGE OF LINO LAKES <br />COUNTY OF ANOKA <br />STATE OF MINNESOTA <br />AN ORDINANCE REGULATING OPEN BURNING WITHIN THE VILLAGE OF LINO <br />LAKES, ANOKA COUNTY, MINNESOTA, AND PROVIDING PENALTIES FOR THE <br />VIOLATION THEREOF. <br />THE VILLAGE COUNCIL OF THE VILLAGE OF LINO LAKES, ANOKA COUNTY, <br />MINNESOTA DOES HEREBY ORDAIN: <br />SECTION I. DEFINITIONS. <br />A. PERSON. Shall be as defined in Minnesota Statutes 1967, Section <br />116.06, Subd. 8. <br />B. OPEN BURNING. Burning any matter whereby the resultant combustion <br />products are emitted directly to the open atmosphere without <br />passing through an adequate stack, duct or chimney, as defined by <br />State law. The matter allowed to be burned shall not include any <br />garbage or other putrescible solid wastes, rubber or other similar <br />materials which may produce an unreasonable amount of air con- <br />taminates. <br />C. RECREATIONAL FIRES. Wood burning fireplaces and open fires used <br />solely for outdoor food preparation. <br />D. BURNING PERMIT. A written permit issued by the Village Fire <br />Marshall authorizing fires exempted from the general provisions <br />hereof, and setting conditions therefor. <br />SECTION II. OPEN BURNING PROHIBITED. <br />From and after the effective date of this ordinance, except as <br />herein otherwise provided, open burning shall be prohibited within <br />the Village of Lino Lakes. <br />
