ORDINANCE NO. 57B <br />VILLAGE OF LINO LAKES <br />COUNTY OF ANOKA <br />STATE OF MINNESOTA <br />AN ORDINANCE AMENDING ORDINANCE NO. 57, AS AMENDED, OF THE <br />VILLAGE OF LINO LAKES, ANOKA COUNTY, MINNESOTA, PASSED BY THE <br />VILLAGE COUNCIL ON DECEMBER 18, 1972, AND IMPOSING A SEWER <br />AVAILABILITY CHARGE TO PAY RESERVE CAPACITY COSTS OF THE <br />METROPOLITAN SEWER BOARD. <br />The Council of the Village of Lino Lakes, Anoka County, Minnesota, <br />does hereby ordain as follows: <br />SECTION I. <br />Ordinance No. 57, of the Village of Lino Lakes, Anoka County, <br />Minnesota, passed by the Village Council on December 18, 1972, <br />as amended is hereby further amended by adding thereto the following: <br />SECTION 14-2. SEWER AVAILABILITY CHARGE TO PAY RESERVE <br />CAPACITY COSTS OF THE METROPOLITAN SEWER BOARD. <br />1. Recitals. As the Metropolitan Sewer Board has determined <br />to reserve unused capacity in the metropolitan disposal system each <br />year commencing in 1973 for local government units in which new <br />buildings to be connected to the system and new connections to the <br />system are commenced during such year; and to allocate the debt <br />service costs of such unused capacity for the year among such local <br />government units as affected, and as the Village of Lino Lakes is <br />affected beginning on March 1, 1973; and in order for the Village <br />of Lino Lakes to pay such costs allocated to it each year, it will <br />be necessary to establish sewer service availability and connection <br />charges for all buildings to be constructed or connected to the <br />metropolitan disposal system on or after March 1, 1973. <br />2. Establishment of Charges. For the purpose of paying costs <br />of reserve capacity so allocated to the Village of Lino Lakes each <br />year by the Metropolitan Sewer Board, there is hereby established <br />a charge for: <br />(a) the availability of treatment works and interceptors <br />comprising the metropolitan disposal system; and <br />(b) connections, direct and indirect, to the metropolitan <br />disposal system. <br />
