ORDINANCE NO. 63 <br />CITY OF LINO LAKES <br />COUNTY OF ANOKA <br />STATE OF MINNESOTA <br />AN ORDINANCE PROVIDING FOR THE LICENSING OF DANCING, OTHER THAN <br />PUBLIC DANCES, AND ENTERTAINMENT. <br />The City Council of the City of Lino Lakes, Anoka County, <br />Minnesota, does ordain: <br />SECTION 1. No individual, corporation or other party <br />shall hold, provide, maintain or allow any dances or dancing or <br />the privilege thereof other than public dances, the primary pur- <br />pose of which is the dancing, as authorized by Ordinance No. 12, <br />as amended, of the City of Lino Lakes, or provide entertainment, <br />with or without such dancing, which entertainment shall include, <br />but not be limited to instrumental music, singing or vaudeville <br />entertainment, stage shows or amusement, whether by an individual <br />or more than one person, and in conjunction with a valid "on <br />sale" intoxicating liquor license or "on sale" beer license, <br />within the City of Lino Lakes, Anoka County, Minnesota, except <br />in accordance with the provisions of this Ordinance and after <br />obtaining a license therefor from the City of Lino Lakes in <br />accordance with this Ordinance, which license shall be called a <br />"Cabaret License". <br />SECTION 2. Such Cabaret License shall be issued by the <br />City Clerk -Treasurer on application therefor by anyone so desiring <br />to provide or maintain or allow such dances or dancing or provide <br />such entertainment, if such applicant otherwise complies with the <br />terms of this Ordinance and other Ordinances of the City of Lino <br />Lakes. <br />SECTION 3. Such license shall be either for a yearly <br />period or for a period to be set therein. <br />SECTION 4. The license fee for a yearly period for such <br />license shall be the sum of $200.00 and for any shorter period <br />shall be $20.00 for each day authorized by such license. <br />SECTION 5. No such license shall be granted to any person <br />of bad character or who has been convicted of a felony, gross mis- <br />demeaner or violation of any provision of this Ordinance, nor to <br />any person who is or has been a keeper of any disorderly house of <br />any kind. <br />SECTION 6. Nothing herein shall prohibit the use of radio, <br />television or juke boxes, without dancing in conjunction therewith, <br />when such does not constitute or become a nuisance or violate any <br />other Ordinance of the City of Lino Lakes or of the State of <br />Minnesota. <br />SECTION 7. The first licenses hereunder shall be issued <br />for a period to commence January 1, 1975, and to terminate June <br />30, 1975, with the annual fee therefor to be pro -rated for such <br />period, with the license periods after July 1, 1975, to be annually <br />from July 1 through June 30 of the following year, except as listed <br />in SECTION 3, above. <br />SECTION 8. Any person violating any provision of this <br />Ordinance shall be guilty of a misdemeanor, and upon conviction <br />thereof shall be punished by a fine of not more than three hundred <br />dollars ($300.00) or imprisonment in the county jail for not more <br />than ninety (90) days, or both. <br />
