ORDINANCE NO. 67 <br />CITY OF LINO LAKES <br />COUNTY OF ANOKA <br />STATE OF MINNESOTA <br />AN ORDINANCE PROVIDING FOR THE DISPOSITION OF UNCLAIMED PROPERTY. <br />The City Council of the City of Lino Lakes, Anoka County, <br />Minnesota, ordains: <br />Section 1. Any property coming into the possession of the <br />City of Lino Lakes in the course of any municipal operation, and <br />remaining unclaimed by the owner thereof for a period of sixty <br />(60) days, shall be deemed unclaimed property pursuant to Minnesota <br />Statutes Annotated 471.195, as amended, and as same may be amended <br />in the future, and such unclaimed property shall be disposed of in <br />the manner provided herein. <br />Section 2. The City shall sell, to the highest bidder at <br />public auction or sale, all such unclaimed property following at <br />least one (1) published notice thereof not less than two (2) weeks <br />prior to such public auction or sale. Such published notice shall <br />contain the following information: <br />1) The date, time and place of the sale. <br />2) The general description of the property to be sold. <br />3) Whether or not the property will be sold piecemeal or <br />otherwise. <br />4) The terms of payment. <br />5) That the sale will be at public auction and to the <br />highest bidder. <br />Section 3. The proceeds of any such sale shall be placed in <br />the general fund of the City, or in such other fund of the City as <br />the City Council may, from time to time, designate by resoltuion. <br />The former owner of any such property so sold may claim the sale <br />price of the sale of such former property within six (6) months <br />from the date of the sale, from such fund, provided however, that <br />such former owner shall only be entitled to such sale price upon <br />proof of such former ownership and less reasonable expenses incurred <br />in the storage, care, keeping and sale of such property. <br />Section 4. This Ordinance shall take effect and be in full <br />force from and after its passage and publication according to law. <br />
